How the Auction works?

First Auction; (see second auction below)
On Wednesday July 31st,  2019 at 10am, at TJON AJONG & ASSOCIATES / NOTARY OFFICE SXM, Front Street # 5, Suite 4, Philipsburg, Sint Maarten, Ms. Faride Tjon Ajong, civil law notary in Sint Maarten, or her deputy, shall proceed with the public sale of the hereinafter mentioned  immovable property:

Immovable Property #1    (residential lot in the Oyster Pond subdivision)

*Description: a residential lot in the Oyster Pond subdivision situated at the Oyster Pond Road, known as Lot 1 of Section V of the development of Oyster Pond Development Corporation NV in the Upper Prince’s Quarter district of Sint Maarten, and is comprised of two parcels of land, resp. 1,933 m² and 215 m² in size, further described in certificates of admeasurement numbers 186/1987 and 373/2004;

Offers in writing can be made for purchasing property auctioned ex article 3:268 paragraph 2 of the Civil Code. A bid form to that effect can be downloaded from our web site or acquired at our office. Such offer can be made to the aforementioned civil law notary up to and including July 16th, 2019 the latest at 17:00 hrs (5pm). Any offer not accepted before July 24th, 2019, is deemed to be declined.

Seller has the right to change the Reserve Price before the auction and to postpone or stop the auction at any time. The auction will take place by raising bids (in Dutch: "bij opbod") and by decreasing bids (in Dutch: “bij afmijning”), in one session. Seller has the right to not accept any bid, at his sole discretion. The General Conditions of Auction and special conditions of auction are applicable. Contact our office for a copy. All auction costs are for the account of the buyer, which may include outstanding condominium association fees and/or outstanding ground rent ("erfpachtcanon"). Each bidder must identify himself with a valid passport or a National identification card. Legal entities have to submit recent extract of the Chamber of Commerce and articles of association. The successful bidder must submit a bank-guarantee, issued by a bank with office in Sint Maarten, to the amount of the highest bid augmented by the auction costs.
